Terms and conditions
This English version is a convenience translation. Only the German version is legally binding: Allgemeine Geschäftsbedingungen.
Last updated: 7 November 2026
§ 1 Scope
- These terms and conditions (the "terms") apply to all contracts on the use of the online application Video Automation, including its application programming interfaces (the "service"), between Internet am Dornbusch, owner Sajjad Hanifa, Eschersheimer Landstraße 297, 60320 Frankfurt am Main, Germany (the "provider") and its customers.
- The service is aimed exclusively at businesses within the meaning of § 14 of the German Civil Code (BGB), legal entities under public law and special funds under public law. Consumers within the meaning of § 13 BGB are excluded from use; a consumer right of withdrawal therefore does not exist. By signing up, the customer confirms that it is acting as a business.
- Deviating or additional terms of the customer only apply if the provider expressly agrees to them in text form.
§ 2 Services of the provider
- The service makes it possible to publish videos and, where the respective platform supports it, images and texts on the customer's accounts at YouTube, TikTok, Instagram, Facebook (Pages), Threads, LinkedIn, Pinterest, X and Bluesky, immediately or at a scheduled time. This includes a dashboard with calendar, queue, history, account management, team with roles, API keys and webhooks, a REST API (version 1) and an interface compatible with the Upload-Post API, as well as connect links through which the customer's end customers can connect their accounts.
- The service uses only the platforms' official interfaces. The customer connects accounts through the platforms' sign-in flows (OAuth), for Bluesky with an app password.
- The scope of each plan follows from the service description and the price list valid at the time of booking, in particular the number of profiles, uploads and users.
- Which features are available on a platform is decided by that platform. Some platforms require a review or approval of the provider's app before public posting is possible and limit the visibility of posts or the number of users until then. The provider states the current status in the FAQ. The provider does not owe that a platform offers a particular feature or grants an approval.
- The provider may develop and change the service as long as the agreed scope of services is not significantly reduced and the change is reasonable for the customer. If a platform changes its interface or terms, the provider adapts the service as far as this is possible with reasonable effort.
- The provider uses service providers to deliver the service, in particular for hosting, e-mail delivery and payment processing. § 13 applies to personal data.
§ 3 Sign-up, conclusion of contract and trial
- The presentation of the service on the website is not a binding offer.
- To sign up, the customer enters name, company, e-mail address and a password in the app and accepts these terms and the privacy policy. When sign-up is completed, a contract for a free trial of 14 days is concluded. No payment method is needed. The trial includes 2 profiles and a total of 50 uploads.
- The customer books paid plans in the app through the checkout of the payment service provider Stripe (§ 6). The contract for the paid plan is concluded when the checkout is completed successfully.
- If the customer does not book a paid plan by the end of the trial, the contract ends automatically when the trial expires, without notice of termination. No costs arise.
- The customer provides true and complete information when signing up and keeps it up to date.
§ 4 Plans, prices and uploads
| Plan | Price per month | Profiles | Uploads per month | Users |
|---|---|---|---|---|
| Trial (14 days) | free | 2 | 50 in total | 1 |
| Starter | €15 | 5 | 1,500 | 1 |
| Pro | €33 | 25 | 6,000 | 3 |
| Business | €119 | 75 | 25,000 | 7 |
| Agency | €349 | 225 | 100,000 | 15 |
- Prices are in euros, net, plus statutory VAT. With yearly billing, the yearly price is ten times the monthly price. The price list valid at the time of booking applies.
- One upload is one post to one connected account. Publishing the same post to three accounts counts as three uploads. An upload is counted when the post is created, even if the platform later rejects it. If the customer deletes a scheduled post before its publication has started, the upload is credited back.
- The upload allowance applies per calendar month, also with yearly billing. Unused uploads expire at the end of the month and are neither carried over nor refunded. Once the allowance is reached, the service accepts no further uploads until the next calendar month begins, unless the customer moves to a higher plan.
- A profile is a group of connected accounts, for example for one brand or one end customer, with at most one account per platform. API use is included in every plan. Connect links with the customer's own name and logo (white label) are included from the Pro plan.
- The provider may change prices with effect for a future billing period. It announces price changes in text form at least six weeks before they take effect. Running subscriptions keep their price until the change takes effect. The customer may cancel the plan until the change takes effect; the provider points this out in the announcement.
§ 5 Fair use and technical limits
- The service is intended for publishing own or licensed content of the customer and its end customers. Technical limits apply per plan, in particular to the number of API requests per minute, the size of individual files and storage space. The limits are stated in the price list or the API documentation.
- The platforms set their own limits, for example a maximum number of posts per account and day, or a shared daily quota for all users of an app. If a post reaches such a limit, the service may publish it later or not at all. The provider allocates shared quotas fairly among all customers at its reasonable discretion.
- Use that goes beyond the normal use of a plan and puts a disproportionate load on the provider's infrastructure or the shared quotas at the platforms is not permitted, in particular mass publishing of identical or nearly identical content, spam, artificially generating reach and automated requests outside the intended interfaces.
- If a customer's use places a considerable burden on the service or other customers, the provider may throttle the requests concerned. It informs the customer and gives it the opportunity to adjust its use or move to a suitable plan.
§ 6 Payment and invoices
- The fee for paid plans is due at the beginning of each billing period (month or year) and is collected in advance from the stored payment method.
- Payment is processed by the payment service provider Stripe Payments Europe, Limited, Dublin, Ireland ("Stripe"). The payment methods shown in the checkout are available, for example card payment and SEPA direct debit. Stripe's terms apply in addition.
- The customer receives invoices by e-mail and can download them in the Stripe customer portal, which it opens from the app.
- If the customer is in default of payment, the provider may block publishing after prior notice in text form and expiry of a reasonable period. The obligation to pay remains.
§ 7 Term, plan changes and cancellation
- Paid plans run for one month or one year, as chosen, and renew automatically for the same period unless cancelled by the end of the current billing period.
- The customer can book, change or cancel a plan at any time in the app. It can also cancel in text form, for example by e-mail to info@my-video-automation.com. A cancellation takes effect at the end of the current billing period; until then, the booked plan remains usable.
- A move to a higher plan (upgrade) takes effect immediately. The price difference for the rest of the current billing period is charged pro rata. A move to a lower plan (downgrade) takes effect at the end of the current billing period. By then, the customer ensures that profiles, users and webhooks fit within the limits of the lower plan; otherwise the service may reject new posts until the limits are met.
- Fees already paid are not refunded pro rata on cancellation or downgrade, except in the case of a justified extraordinary termination by the customer.
- The right of both parties to terminate for good cause remains unaffected.
- The customer can export its data as a JSON file in the app and delete its workspace itself at any time; deletion takes effect immediately and cannot be undone. Otherwise, the provider deletes the customer's data 30 days after the end of the contract, unless statutory retention obligations apply. Independently of this, the provider deletes uploaded media after the plan's retention period.
§ 8 Platform rules and responsibility for content
- The customer decides what is published, when and on which accounts, and is responsible for the published content. It ensures that the content does not violate applicable law or third-party rights, in particular copyright, trademark, personality, competition and youth protection law, and that it holds the necessary rights to music, images and the people shown.
- The customer complies with the terms of service, policies and community guidelines of every platform on which it publishes. This includes in particular obligations to label advertising, paid partnerships and content created or altered with artificial intelligence, information on content made for children, and the confirmations a platform requires before posting. The service provides the fields the platforms offer for this; the customer makes the correct choice.
- Anyone who uploads videos to YouTube through the service agrees to the YouTube Terms of Service. Google's processing is governed by the Google Privacy Policy.
- The customer only connects accounts it is authorised to use. If it passes connect links on to end customers, it ensures that these end customers connect their accounts voluntarily, are informed about the processing and comply with the rules in this section. The customer is responsible towards the provider for posts on its end customers' accounts.
- If the customer sets up scheduled posts, queues or automations through the API, the service publishes according to these settings. The customer is responsible for the settings.
- If the customer or an end customer violates platform rules or this section, or if a platform asks the provider to do so, the provider may temporarily pause publishing for the accounts, profiles or the entire workspace concerned and hold scheduled posts. It takes the customer's legitimate interests into account, limits the measure to what is necessary and informs the customer without delay. If a violation endangers the provider's access to a platform for all customers, the provider may act without prior notice.
- If a platform blocks, restricts or deletes an account or post of the customer, this is the platform's decision. The provider has no influence on it.
§ 9 Obligations of the customer
- The customer keeps its login details and API keys secret. It gives team members only the roles and permissions they need and is responsible for actions in its workspace and with its API keys. If it suspects misuse, it disables the API key concerned and informs the provider.
- The customer keeps its own copies of its videos and content. The service is not an archive; uploaded media are deleted after the plan's retention period.
- The customer verifies webhook notifications using the signature (HMAC-SHA256) and operates the receivers of its webhooks itself.
- The customer only enters personal data of third parties if it is entitled to do so.
- The customer refrains from anything that impairs the function or security of the service, in particular circumventing technical limits and injecting malicious code.
- If the customer breaches these obligations, § 8 (6) applies accordingly.
- The customer indemnifies the provider against third-party claims, including claims by the platforms, that are based on a culpable breach of the obligations under § 8 or § 9, including reasonable costs of legal defence.
§ 10 Connect links and white label
- The customer can create connect links in the app or through the API. Through such a link, its end customers connect their accounts to a profile of the customer without needing their own Video Automation account.
- From the Pro plan, the customer can brand the connect page with its own name and logo. The customer ensures that it holds the rights to the name and logo.
- Even with white label, the platforms' sign-in pages show the name of the provider's app, because the connection runs through the provider's access to the platform.
§ 11 Rights to content and to the service
- Content that the customer brings into the service remains its content. The customer grants the provider the simple right to store and process it, to make it available to the platforms at unguessable addresses and to publish it on the chosen platforms, as far as this is necessary to provide the service.
- For the term of the contract, the customer receives the simple, non-transferable right to use the service within the scope of its plan.
§ 12 Availability
- The provider strives for the most uninterrupted availability of the service possible. It only owes a specific availability if this is expressly agreed.
- The provider carries out maintenance at times of low usage where possible. Scheduled posts that fall into a maintenance window are published as soon as possible afterwards.
- The service depends on the platforms' interfaces. Outages, changes, quotas, review procedures and decisions of the platforms are outside the provider's control, as are expired or revoked connections. The provider is not responsible for them. The service retries failed publications where this makes sense and shows the customer the status and the platform's error messages.
- There is no claim that a post appears on a platform at a specific minute. The platforms process videos themselves after upload, which can take a few minutes.
§ 13 Data protection and data processing
- The customer is the controller within the meaning of the GDPR for personal data it processes in the service, including the data of accounts that its end customers connect through connect links; the provider processes this data as processor. The data processing agreement under Art. 28 GDPR applies in every plan for this purpose. It is part of this contract.
- Otherwise, the privacy policy applies.
§ 14 Liability
- The provider is liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee it has given.
- In the case of slight negligence, the provider is only liable for breach of material contractual obligations, i.e. obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the customer may regularly rely. In this case, liability is limited to the foreseeable damage typical for this type of contract at the time the contract was concluded.
- Strict liability for defects that already existed when the contract was concluded (§ 536a (1) alt. 1 BGB) is excluded.
- The provider is only liable for loss of data to the extent that the damage would also have occurred if the customer had backed up its data properly (§ 9 (2)).
- During the trial, the provider is liable only for intent and gross negligence, except in the cases of paragraph 1.
- These limitations also apply to the provider's legal representatives, employees and vicarious agents.
§ 15 Changes to these terms
- The provider may change these terms with effect for the future if there is a valid reason, such as a change in the law, changed terms of a platform or the further development of the service, and the balance between performance and consideration is not significantly shifted to the customer's disadvantage.
- The provider announces changes in text form at least six weeks before they take effect. If the customer does not object by the time they take effect, the changes are deemed accepted. The provider points out the right to object and the consequences of silence in the announcement. If the customer objects, either party may terminate the contract as of the date the changes take effect.
- If the provider has to change the service at short notice because a platform changes its interface or terms, the period in paragraph 2 does not apply to the necessary adjustments of the service; the provider informs the customer as early as possible.
§ 16 Final provisions
- The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
- If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Frankfurt am Main. The provider may also sue the customer at its general place of jurisdiction.
- Changes and additions to the contract require text form.
- If a provision of these terms is invalid, the remaining provisions remain valid. The statutory provision takes the place of the invalid provision.
- The German version of these terms is binding. The English version is for information only.
